The law firm is frequently retained to draft ovum, sperm, and embryo donation agreements for intended parents. The donation agreements between recipients and their donor detail the parties’ rights, obligations and expectations with regard to the donation, and address legal issues including identity, confidentiality, parental rights, obligations with respect to future contact and/or medical information, medical expenses, liability for complications, taxation of monies, and the rights of the child.
An ovum donor is a woman who donates her ova to use in the conception of a child conceived through the process of in-vitro fertilization. Ovum recipients contact the law firm because a medical reason has prevented the recipient from conceiving a child with her own ova. Ovum recipients are not always female; clients also include gay male couples and single males. The firm can assist recipients by referring them to various ovum donor agencies so that the recipients can locate an ovum donor. Once recipients have selected an ovum donor and are ready to retain the donor agency, the law firm can both review the agreement between the intended parents and the agency and draft and negotiate the ovum donation agreement between the intended parents and their ovum donor. Similar contracts are drafted for embryo donors and sperm donors.
